That's why I think the step-dad could get charged not with murder, but a lesser crime, maybe aggravated assault, or something. He clearly escalated it since the bio-dad was unarmed and threatened civil court only.

They are both guilty.

The step-dad for bringing a rifle to a civilian matter.

And the bio-dad for escalating it one step further by threatening to take it and use it on him.

But I also don't think the bio-dad believed step-dad would carry through with it. He must have thought it was a bluff. I wonder if he truly thought step-dad would carry out the threat, he would have backed down and went back to his car threatening civil court again.

Looks like Kyle was within his rights.

The second she wouldn't let me get my son, is the second I get the fuk off their property, call the cops, say my son was kidnapped by the mother and just wait


I would then show the police my court order stating which days I get him.

Yep, got that. Also, another key note is in TX law permitting brandishing to protect (with no time frame specified). Whereas here in AZ, we can't brandish until after there is immediate threat of unlawful physical force or deadly physical force.

So, here, he could still be accused of some lesser charge for "provocation". Whereas TX apparently has the most liberal and best use of force laws I've seen all-around so far. Too bad that's not all states!

Still messed up situation though. I personally would not have brandished, I would have just given him the kid as previously agreed upon and avoided escalating. The less drama, the better.

Ok, so Jennifer Read (step-mom, not bio-mom) is the dead man's new wife of two months. Jennifer is trying to take away the kids from the bad lady, (bio-mom) Christina Read, who is responsible for this murder. She is also asking for the bad lady (bio-mom) to pay child support. She is also accusing the bad lady of plotting this murder of the dead man as a set-up since she provoked it, filmed it, and did nothing to stop it, nor render aid.

Thanks for clearing that up. I'm not especially good at deciphering the types of documents I posted a link to previously. Just too many names for my stupid brain.

If the dead guy said he would take the gun and use it on the shooter, gonna be hard pressed to show it wasn't self defense.

There will be an issue about him coming out with the gun, but his wife/gf was outside with the dead guy. I would go back out to protect my wife as well.

Warning shot might be hard to explain at court.

Castle doctrine/stand your ground can excuse a lot of things. Colorados castle doctrine states lethal force can be used when the suspect is illegally entering the home and (among other stipulations) the resident believes physical force will be used against them HOWEVER SLIGHT THAT PHYSICAL FORCE MAY BE (so that chest bump would count). So, you start kicking on my door saying you'll kick my azz, I can shoot you because you're attempting illegal entry and threatened to use force. Obviously this situation occurred outside but it all depends how that states law reads.

My thought is if it even goes to trial, shooter is cleared of wrongdoing.

chad threatened to kill the manlet, and reaches for manlet's gun. at that point it's self defense, manlet's life is clearly in danger, and he has every right to kill Chad. Highly doubt manlet does a day of jail time
