Feel really bad for the kid.
Edit: Kyle Carruth (the shooter) is actually an attorney, not a tradie.
This will be an interesting case to follow.

That's why I think the step-dad could get charged not with murder, but a lesser crime, maybe aggravated assault, or something. He clearly escalated it since the bio-dad was unarmed and threatened civil court only.
They are both guilty.
The step-dad for bringing a rifle to a civilian matter.
And the bio-dad for escalating it one step further by threatening to take it and use it on him.
But I also don't think the bio-dad believed step-dad would carry through with it. He must have thought it was a bluff. I wonder if he truly thought step-dad would carry out the threat, he would have backed down and went back to his car threatening civil court again.

“Though Read came unarmed, he announced his intent to kill Kyle Carruth with Kyle’s own gun and took immediate powerful action to do so,” Guinn said. “[It] was unsuccessful.”
Guinn released a second video to EverythingLubbock.com in his support of his case for Carruth’s self-defense.
“Careful study of the video showed Kyle’s gun was brandished but never pointed at Read,” Guinn said. “It was only after Mr. read said ‘I’ll take your gun,’ and slinging him across the patio like a scarecrow — then stepped toward him — that Mr. Carruth pointed the gun at Mr. Read.”

Still, he did undeniably provoke the event in my opinion.
If he'd waited inside until the father had either physically threatened the mother, or tried to press his way in the house - then shot the father, I'd have no sympathy for the father.

The second she wouldn't let me get my son, is the second I get the fuk off their property, call the cops, say my son was kidnapped by the mother and just wait
I would then show the police my court order stating which days I get him.
Fuk if I am dealing with psycho's out there......
Play stupid games, win stupid prizes. I have a son and would never put myself in that position. Fuk that noise.

So, here, he could still be accused of some lesser charge for "provocation". Whereas TX apparently has the most liberal and best use of force laws I've seen all-around so far. Too bad that's not all states!
Still messed up situation though. I personally would not have brandished, I would have just given him the kid as previously agreed upon and avoided escalating. The less drama, the better.

The killer was actually cheating on his wife the Judge with the dead man's ex-wife (mother of the kids he was picking up).
The dead man just got married to another new wife two months ago, and this new wife is now accusing both the killer and the mother of those kids as plotting this as a murder since the dead man was apparently threatening to expose the killer's affair with his ex-wife.

If the dead guy said he would take the gun and use it on the shooter, gonna be hard pressed to show it wasn't self defense.
There will be an issue about him coming out with the gun, but his wife/gf was outside with the dead guy. I would go back out to protect my wife as well.
Warning shot might be hard to explain at court.
Castle doctrine/stand your ground can excuse a lot of things. Colorados castle doctrine states lethal force can be used when the suspect is illegally entering the home and (among other stipulations) the resident believes physical force will be used against them HOWEVER SLIGHT THAT PHYSICAL FORCE MAY BE (so that chest bump would count). So, you start kicking on my door saying you'll kick my azz, I can shoot you because you're attempting illegal entry and threatened to use force. Obviously this situation occurred outside but it all depends how that states law reads.
My thought is if it even goes to trial, shooter is cleared of wrongdoing.

chad threatened to kill the manlet, and reaches for manlet's gun. at that point it's self defense, manlet's life is clearly in danger, and he has every right to kill Chad. Highly doubt manlet does a day of jail time

I think the bio dad interpreted the step dad's rifle as a bluff stance and did not believe he would actually shoot it since he wasn't there to threaten anyone but just get his kid (threatening to take to court is not the same as threatening their life). Also, unarmed is no match for a rifle, also he pushed him out of the way so he could go look inside his home to get his kid, the push was no way life threatening. Step dad was in zero danger for his life. He'll get prison.
