So the states are using the 14th amendment to say “He’s disqualified because of an insurrection”, but they cannot DQ him at a state level. It must come from the Supreme Court and/or congress, because this extends passed the constitutional authority of the states.
The process begins by an authority with jurisdiction, in this case the Maine SOS, making a determination. It was immediately then put on a path through the courts so it can reach a final determination at the federal level. Let's try to make this more clear; anything in the constitution pertains to the federal government, and restraint of what the government can and cannot do. If it is not in the constitution, then it becomes state, and not federal. The contradiction is that the states are using the constitution to make their arguments, but this is not a state issue because it is specifically written in the constitution, which makes it a federal issue.
In other words, a state cannot make a decision that takes away the rights, or goes against the will of the rest of the nation. If a decision affects people outside of the state, then it is not a state issue. This is why the constitution was written, and it is unconstitutional for states to make this decision for the rest of the nation.
This is constitutional law 101, but it is amazing how many brain dead people who have no concept of basic constitutional law, or adamant they are right. This is also an indication of just how extremist these states have become. A state that takes away the voting right of at least half the nation, would be considered a dictatorship
