This appeal is for presidential immunity- and double jeopardy.
What should happen
-it gets rejected today (because of "first impression" Nixon Fitzgerald)
-it gets appealed to full circuit - where it also gets rejected for same reason
- Then it gets appealed to where it becomes open season. As well once it gets to scotus, they can expand beyond the reason of appeal to anything regarding the case.
William Shipley's take
1. An amicus brief filed by American oversight -the court has accepted to be heard on from both parties- that says if rejected, it should go back to the judge for trial instead of appeal for Supreme Court- that scotus appeal would happen after trial.

The court agreeing with that wouldn't be good for Trump.
2 An amicus brief filed by Meese that states Jack Smith wasn't qualified to be special prosecutor (this can also be considered by scotus later)

If that happens - entire thing could be thrown out - and a new prosecutor has to redo the charges all the way back to Grand jury.

"He will not win CADC because they are not writing on a blank slate. There is enough language in various decisions over time that CADC would be breaking from prior decisions to find, as a matter of first impression, that a former POTUS has criminal immunity.
But POTUS gets to write on a blank slate. Nixon v. Fitzgerald means nothing as the issue was neither briefed nor argued before the Court. A few words in a footnote from a 40 year old case will not influence the outcome. The policy issues raised in Nixon that FAVORED immunity, on the other hand, remain the same today -- and maybe even more significantly than they did four decades ago.
And US v. Nixon doesn't get you there either because the balancing of the claim of immunity from production in that case came against the due process rights - potentially to exculpatory evidence - of the Watergate defendants. Not being immune to a court order requiring the production of material needed by Nixon's own DOJ to meet its due process obligations is not remotely close to the question of immunity for prosecution by the political opposition after leaving office."

2 Biden judges and a cuck H.Dubya Bush judge? Lmao, zero chance they rule in Trump’s favor.
I actively disagree it’s a mistake for him to attend. He needs to be visible for all of these political persecutions. Stay front and center of it all. It reminds the public what they’re doing to our country.

The big injustice, this lib panel could do- is agree with the amicus - and move it back to trial with no scotus appeal.

The questions is if they let it get there pre-trial
Given what he had to work with - Trumps lawyers was incredible
Hopefully this moves to full circuit then SCOTUS
