Could i be in legal trouble? One of my employees works off the clock for free.
His choice mind you.. He been with us for a while and a good worker and generally very quite and keeps to himself and anything he's talking to other employees, it's always work related. Very professional but also kind of a downer in the office. When we invite him out to drinks after work, he comes but leaves early, saying he has work to finish. We always thought he was just a family man and he kept his work life and home life completely separate but no the guy lives alone but he's literally coming back into the office and working. I don't offer OT as all my employees are salary and i've even tried to an exemption and offer him some kind of compensation but he refuses mumbling "work to do, work to do" and walks away. Do i have to fire him since i could be in legal trouble?

I've never held a salary position so I'm not sure how that works but doesn't salary mean you can work extra hours and not be paid for it? You're not ever really "off the clock"?

This sounds like a horror movie.
On the one hand, he's not doing anything wrong technically and is a hard worker.
On the other hand, this sounds like a horror story.
Good worker.
Kind of a downer though…
