I can't imagine how this guy must be feeling. I'm sitting here bitching about how cold it's gonna be in Sweden, and this guy is facing the fact that he killed 4 innocent people and is facing 10 years in prison. He'll probably only serve a fraction of that, but still.

10 years seems a bit much. In my town a few years ago, a teenage girl drove over an old man killing him while she was texting and driving. Didn't get any time.

Here's my take on it.

1) The guy did not have any criminal intent, that alone should be enough to keep the prison sentence below 5 years IMO. A trucker who texts at the wheel and hits only a light post doesn't get 10 years, why should this guy? Because he was so unlucky to be coming up to a traffic jam while he was being a dumb ****?
2) Locking this guy up forever will not act as a deterrent. A much better deterrent would be to have large fines coupled with a significant chance of getting busted (e.g. use a driver cam that the cops can query).
3) A deterrent is not even such a great idea in this case. Everyone knows they shouldn't text at the wheel, they just don't think about the possible consequences. Information campaigns work much better in such cases. Make people aware of the responsibility they carry as a driver. Make them aware of the huge amounts of energy involved in driving. Make them aware that being distracted at the wheel is similar to holding your kid over the balcony railing.

I bet nearly everyone asking for the death sentence (which we don't even have in the UK lol) or who are pleased with the 10 year sentence has themselves taken their eye off the road in the past to check their phone or change the radio station.

The guy was just unlucky. He didn't mean to kill anyone. He's probably devastated and has to live with the fact that he killed 4 people for the rest of his life. The 10 year jail sentence is just a poorly thought out attempt at 'deterrence' and a need for vengeance because he killed young people. Yet right now on the road I can guarantee there are people doing the exact same thing he did, some probably to a worse extent, who will never be punished because they are lucky enough to not be in the wrong place at the wrong time while being distracted.

So much this. My friend was killed Saturday morning by a drunk driver, that just a couple weeks ago, completed her dui classes. How the fuk do you just finish courses and do the same fuking thing? And only get charged with manslaughter? She killed my friend and another guy...she consciously got behind that wheel, which makes it deliberate..just my opinion.

Why is it so perplexing to comprehend that endangering/harming/killing another person (accidentally or intentionally) incurs a higher consequence than damaging a pole? It's hardly the "exact same action".

only time ive used my phone while driving is to use google voice to make calls, texting requires too much concentration and you're basically blind for 5~ seconds which is huge.

It's the exact same action. You are driving home drunk and at some point you pass out and hit something. Most of the time it's a pole or a fence and on the rare occasion it is a person. But you did perform the exact same action to reach either outcome.

If you wake up and fire 3 random shots out your window, the penalty will be different if you hit a pole compared to hitting a random person walking by.

On paper yes it is. Not with the UK justice system. The system hands out"Justice"and rehabilitation. There is no room in the justice system for: revenge/retribution/vengeance. The word punishment gets thrown around a lot but no sentence handed out is just a "punishment" In the traditional sence. The "punishment" is disposed to protect the public/change behaviour (rehab), punishment doesn't hold the exact same meaning in the justice system as in the general public (revenge).


10 years a joke for being sentenced at a crown court though:

-4 counts of causing death by dangerous driving.
Min = 2 years Max = 14 years

-1 count of causing serious injury by dangerous driving.
Min = 6 months Max = 5 years

Consecutive Total
Total Min - 8 years + 6 months
Total Max - 61 years (life)

Concurrent Total
Min = 2 years
Max = 14 years

In general Guilty plea will earn you 1/3 reduction off sentencing*

He most likely received a maximum concurrent sentence or close to it with guilty plea reduction. I think where the real problem lies in the totality of the sentence whether consecutive or concurrent also the nature of ALL driving offences and how they are dealt with. 10 years feels low as fuk for 4 lifes taken however it feels long as fuk for learning not to use your phone while driving.

My friend (first girl I ever kissed, actually) was killed a few months ago by some bish in a truck. Elise (my friend) was riding a scooter, got rear-ended by Cortney (aforementioned bish), flung into oncoming traffic and run over by a car. Cortney kept driving, dragging Elise's scooter along for like half a mile before stopping and pulling it out from under the front bumper, then driving off again. She finally turned herself in, but looks like the charges only carry a 2 year sentence because they can't prove recklessness. Great lesson to be learned, if you accidentally kill someone because you were texting or drunk driving, drive off and turn yourself in later.

Lol, guaranteed you wouldn't be screaming below 5 years if it was your mother, sister, brother or someone of importance that was killed here. I can 100% guarantee it. You'd want to kill him yourself or DEMAND he face the highest possible sentence imaginable. Let's call it for what it really is.

If you undercook food by a mistake, let's say your thermometer was broken and gave a misreading, you serve the food to someone, they get food poisoning. It's not like you intended to give that person food poisioning, infact you went out of your way, even used a food thermometer, had no reason to suspect it was broke, food looked right, etc...

Another example -

Mother is looking after her child in the playground, another parent talks to her, she briefly isn't watching what her child is doing, something happens to child. The mother consciously made a decision to speak to the other parent, she only looked away from her child for 5 seconds. Therefore she intended on her child getting hurt? Obviously not.

Intentions are the important thing here.
Intentions are important - and that's why there's a huge difference between criminal negligence, and merely participating in a dangerous sport, making a dangerous meal because of an error that would not be reasonably suspected, or taking your eye off your child for a few seconds in a playground.

Nobody agrees to be on the road with a truck driver texting for 10 seconds, but the truck driver chose to do such an action. That isn't part of the deal. His intentions were not death, but his intentions were criminally negligent. Whereas none of your examples are.
