Good points but I think Wincel is confusing it with the duty to assist or whatever.. they somewhat go hand in hand and eventually I’m sure someone would sue from being saved from suicide lol... “I donated all my **** and was going to kill myself- ******* saved me and now I’m homeless and have no money”

I'm good friends with the family of the boy. He was a good kid, with obvious issues. She made a horrific mistake, screaming for attention and obviously mentally ill.

There are no winners here. No peace. She's crazy, I feel bad for her parents. I feel terrible for his family. I watched the Dateline and almost turned it off halfway through, I was so disgusted.

She deserves some time, she'll be a pariah to society like Casey Anthony.

Parenting teenagers today is one of the toughest jobs there is. It's a nightmare.

"Failure to perform a legal duty expressly required to safeguard human life," is part of the definition of manslaughter.

She knew what he was doing and failed to call 911 to get him help. I'm pretty sure that's why manslaughter fits in this case.

I believe "legal duty" refers to those with training or in positions of responsibility. For example the foreman of a construction site where an accident has occurred. , but not a random bystander .

it depends. you have a legal duty to not be negligent all the time, no matter where you are.

if you randomly chuck a brick over your neighbors fence, and you accidentally hit your neighbor in the head, you had a duty to not do that

You just made a chity argument... I too am worried about the legal precedence generated by "manslaughter" used to charge cyber bullying.

I had similar thoughts in the first thread before reading the text messages. She should not be on the street and is a blight on civilization and if I had a button to push "fixing it" I would probably do so.

However, the legal system can not charge her with breaking a law that doesn't exist so they used "manslaughter" and made it fit... If she wasn't so deliberately manipulatively the defense might have won on those grounds, but she is something else.

I had a good day today til I read those text messages, that ultimately truly just saddened me. ****s garbage, he was having a good day, staying happy and her "do it, do it do it," I hope she gets killed non naturally. like an awful mangled car wreck or a meteor smashing into her house. dead serious. I relate because ive had a few of my friends commit suicide in service and as a cop. hits me straight to the core.

Yeah I was thinking about that before... and unfortunately hospitalization can have major consequences on a persons life. You’d have to use very good judgement when deciding to get outside help or not. In this girls case the answer was obvious.. you know if he had confided in just one person that wasn’t her, even made a thread on the misc(just an example lol I’m sure he wasn’t a miscer) he would probably still be here and his family wouldn’t have lost a kid. I guess that’s maybe why she deserves jail time, if she wasn’t involved he probably wouldn’t be dead. It’s a leap for sure but I feel pretty confident about it.

Of course it shouldn't be legally required to report that, unless you're a psychiatrist or doctor and it sounds like it absolutely needs to be addressed.

This isn't really the same thing. They were in a relationship and he wanted to go about his normal life, but she kept reminding him to KYS. This isn't an online FPS where everyone is telling you to "kys *******". Chit, those are just the good ole days. You can't get away with that like you used to. Chit talking online is being policed like mad, and I am against that.

But again, this **** is different. This bitch coerced him into doing it. You can tell from the texts that he would talk about it, but he wouldn't be about it. He seems to just forget about it and talks about his day like normal, but she reminds him again and again. He wouldn't do it because it was in fear that his family/friends would be so devastated after the fact. She made sure to tell him that they would forget about it real quick.

Bury this bitch under the cell for all I care. Every excuse he had for not doing it, she had one to erase that fear and assure him it was the better move to go ahead and do it. The dude was going through a stage of depression.
