Whether or not they call it "in your file" there is certainly a document in HR's folders with everyones names on it and all their statements, your name on it too. The problem is they verbally told you youre in the clear but you have nothing in writing nor do you have a copy, redacted or not, of the report. What if their written report portrays you in a worse light than they led you to believe verbally?

I would atleast want something in writing that matches the " discrepancies in the stories, and determined that there was no malicious intent on my end" part that they told you verbally. You are going on their word while they have more information than they will give you.

It could be two years down the line and someone else makes some stupid complaint against you and now there are new HR people with a chip on their shoulder, dig up the old report and use it as part of a "trend" and the report they had on file portrayed you in a bad light and said something like you were "verbally counseled". Now all you can do is claim the HR weenies that are now gone verbally told you that you were cleared but you have zero proof.

It is absolutely bull**** you had to stress about it for a couple days, but it is over. I kind of want to say you probably could easily find out who did it, but it doesn’t matter. It 100% does not matter.

OP, think about this....

One of these deviants thought it was just to report you to HR over a joke.
They fully understood what the consequences could be for you; in fact they hoped it would happen to you. They wanted to see your livelihood taken from you during a global pandemic - at a time when finding another job is tough.
They probably did this for their own entertainment. They would find it enjoyable to see you down on your knees, struggling.

You should never forget this.

You could turn the other cheek. When you find out who did it, distance yourself from them.

Or, you could get your justice and wait for them to slip up...

You should be able to write a written rebuttal to the investigation and it becomes part of the case file. Ask about that and be VERY tactful in doing so.

Ask questions like the retention policy for the personnel files and the contents of them by item. There should be a policy if your company is worth a damn. If there is a policy then make absolute certain they abide by it. Mark it on your calendar if it is supposed to be removed from your file in a year etc. Ask to review it then and have it removed if still present. Learn the rules and enforce them for your own advocacy.


Also keep in mind how many cops go through this and if you see them getting any **** about their records, stand up. Herp derp, why do police unions advocate for not releasing certain records. I'm all for sustained items but the stain on your record for unsubstantiated claims is horrific.

Get a voice recorder and record everything. Now it might take a while, but when that bitch slips, destroy her whole everything.

I started carrying a digital voice recorder on me a long time ago. For self protection, not to get anyone else. I don’t care what anyone else says or does. It has come in handy a few times.

Lolz I was in HR at my last hospital like 7 times for various incidents. I just don’t know when to keep my my mouth shut sometimes. The head of HR knew me by name in a faciiity with 500+++ people. Most of it was bull**** like some manager telling me I was racist for having a convo with my friend from Ecuador in which I asked if it was safe for a gringo to travel there. I shut them up pretty fast.


This type of **** is one of the reasons I’m starting my own company in 2 years.

I worked in a used car dealership for a year where it was all men. The two top salesman kept getting into serious arguments and the manager brought 2 pairs of boxing gloves and had them settle their differences behind the building after closing one day and brought a case of beer for everyone to drink while we watched. That was a fun workplace

this, OP. HR is trained in telling half-truths and being very misleading while telling you what you want to hear

a very close friend of mine got caught cheating in university, which obviously was obviously added to his file. he wanted to apply to post-grad studies and was worried about other universities finding out, so he asked student resources whether they would reveal this information to other universities. they said they wouldn't. a professor who was helping him with the application process told him to go back and ask them whether they would reveal the information to a university he is applying to IF the admissions committee asked for it, and they said yes

HR can be a bunch of slimy cockroaches. go back to them and ask them under which circumstances a hiring manager could have access to the incident on your file when assessing you as a candidate for a promotion, or under which circumstances HR could reveal the incident in your file to management. gotta be very specific.

it could be that your employer has a policy that states that allegations that are not fully corroborated cannot be used in determining an employee's fit for a certain job. however, it doesn't mean that they won't have access to that information.

That's the chit that pisses me off. Like why the fuk would you do that? It's not like she was angling for my job,so what...You just did it to hang your hat on the fact you got someone terminated for nothing? How much fuking evil can you get? I'm not forgetting this, and I hate to be that guy, but fuk it. If she fuks up I'll be there to pick up the pieces and she can put them together in the unemployment line.

Ask questions like the retention policy for the personnel files and the contents of them by item. There should be a policy if your company is worth a damn. Also keep in mind how many cops go through this and if you see them getting any **** about their records, stand up. Herp derp, why do police unions advocate for not releasing certain records. I'm all for sustained items but the stain on your record for unsubstantiated claims is horrific.

That's how it is where my wife works. It's all folks with military backgrounds and they're used to ribbing each other. The chit they say to each other would get you canned in a heartbeat anywhere else. Not them, they just laugh it off and go about their day.
